Terms and Conditions

 
1. DEFINITIONS

a) The ‘Owner’ is The Surveying Company HB Limited, trading as Drone IT.

b) The ‘Hirer’ is the person entering into this contract and where that person enters into this Contract on behalf of another entity the expression includes such entity. This expression also extends to those claiming under or authorised by him/her/it.

c) The ‘Plant’ means all equipment including tools, accessories, and parts supplied to the Hirer.

2. HIRE PERIOD

a) Hiring charges shall commence from the time the Plant is collected by the Hirer from the Owner’s premises and continue until the return of the Plant to the Owners’ premises or until the expiry of the minimum hiring period, whichever last occurs.

b) If the Plant is not returned to the Owner’s premises within the minimum hire period then additional hiring charges shall be payable.

c) Equipment hire rates are chargeable for each day of hire. Extra days over and above the original agreed hire will be charged additionally pro-rata at the daily rate.

d) Should the Owner agree with the Hirer to deliver and collect the Plant, hire charges shall commence from the time the Plant leaves the Owner’s premises until the time the Plant is returned to the Owner.

3. SHIPPING

a) If the Plant is to be couriered to the Hirer, this will be at the Hirers cost and included in the total hire price. Courier costs will be provided as part of the overall hire price.

b) The hire period will start from the day after delivery. No part of the pre-paid hire period shall be refunded, regardless of when the Plant arrives.

c) Courier payments will be handled by the Owner. A pre-paid return shipping label will be provided with each hire. The Hirer is required to arrange pick up by, or drop to the nearest Owner approved courier service for return of the Plant.

4. HIRE RATES AND PAYMENT

a) The Plant is hired at the rates shown on the Owner’s current web page unless agreed to the contrary between the Owner and the Hirer.

b) The Hirer acknowledges that the product catalogue is that available at the Owner’s premises where the hiring took place and that the Hirer has had every opportunity the Hirer wishes to check the rates applicable and whether or not the Hirer has done so is in the Hirer’s discretion.

c) Except where the Owner dispenses with this requirement a deposit and/or bond shall be paid or given at the commencement of the hire period. Such deposit or bond to be specified in the contract at the Owner’s discretion.

d) All other hiring’s (except Trade Customers) shall be on a cash sale basis and payment shall be made, unless a contrary agreement has been made between the Hirer and the Owner, on the date before the Plant is collected or shipped. Where by the agreement the hire period is extended to more than 7 days during the period of hire, then the hire charges shall at the discretion of the Owner be payable by the 20th of the following month.

e) In the event of default by the Hirer in the payment of any amount due he/she/it shall be liable for interest on the gross amount outstanding at the rate of 15% per month from the date on which payment is due until the date on which payment in full is received.

f) Hire costs must be paid in full upfront before the plant can be released for use. Plant availability will not be guaranteed until full payment has been made.

g) All hire rates are GST inclusive.

5. RESPONSIBILITIES OF HIRER

a) Determine the condition and suitability of the Plant hired for the purpose required.

b) Use the Plant in a skilful and proper manner and only for the purpose and within the capacity for which it was designed.

c) Ensure that the Plant is operated by a suitably qualified operator.

d) Ensure all Unmanned Aerial Vehicle (UAV) flights must conform to the Civil Aviation Authority (CAA) Part 101 regulations. If approved, flights must also comply with Part 102 regulations. The hirer is responsible for ensuring adherence to these rules.

e) Accept full responsibility for, and indemnify the Owner against all claims in respect of any injury to persons, or damage to property, or illegal use, arising out of the use of the Plant during the hire period however arising, whether form negligence of the Hirer or any other person including but without limitation where the Plant is being operated for any reason by the Owner, its servants or agents.

f) Not alter or make any additions to the Plant including but without limitation altering, make any additions to, defacing or erasing any identifying mark, plate or number on or in the Plant or any other part of the Plant or in any other manner interfere with the Plant.

6. OWNERS RIGHT TO TERMINATE

Without prejudice to any other remedies available to the Owner and notwithstanding any period of hire specified, the Owner may terminate this Contract at any time by giving to the Hirer two (2) days (or if the Owner deems it appropriate such lesser period) notice of its intention to terminate. Such notice need not be in writing and shall be deemed sufficiently given if made to the Hirer.

7. PLANT INSURANCE

A 10% surcharge will be added to all hire fees to cover insurance costs. This surcharge is non-negotiable and is included in the total hire price.

8. CANCELLATION POLICY

a) All cancellation requests must be submitted in writing via email to ensure proper processing.

b) Refunds will be processed via internet banking. A bank account must be provided to enable the deposit of funds to be refunded. Refunds may take several business days to reflect in your account.

c) In the event of unforeseen circumstances, such as extreme weather conditions or other emergencies, please contact us to discuss potential options for rescheduling your booking.

d) Cancellation timeframes are outlined below.

i. Cancellations Made More Than 7 Days Before Hire Period:

If you cancel your booking more than seven (7) days prior to the start of your hire period, you will receive an 80% refund of your total hire fee.

ii. Cancellations Made Between 3 and 7 Days Before Hire Period:

For cancellations received between three (3) and seven (7) days before the scheduled start of your hire period, we will provide a 50% refund of your total hire fee.

iii. Cancellations Made Less Than 3 Days Before Hire Period:

We cannot offer any refunds for cancellations made less than three (3) days before the start of your hire period.
